These Terms of Service govern your using the website located at https://ipxyz.network/ , owned and operated by IPXYZ.NETWORK («IPXYZ») and the materials appearing on or otherwise accessed through the Site. YOU ACKNOWLEDGE AND AGREE THAT BY ACCESSING OR USING THE SITE, YOU INDICATE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

We reserve the right to modify, discontinue or terminate the Site or to modify these Terms of Service, at any time and without prior notice. Except as expressly provided in these Terms of Service, IPXYZ.NETWORK exclusively owns all rights, titles and interests in and to the Site, including all associated intellectual property rights. IPXYZ.NETWORK hereby grants you a limited, nonexclusive, revocable, non-transferrable and non-sublicensable license to access and use the Service for the personal or internal business use (the "Purpose"). Such license is subject to this Agreement and does not permit any resale, the distribution, public performance or public display, modifying or otherwise making any derivative uses, use, publishing, transmission, reverse engineering, participation in the transfer or sale, or any way exploit any of the copyrighted work and other intellectual property other than for the Purpose. This granted license will automatically terminate if Bitfury suspends or terminates access to the Account or the Service.

  • modify, adapt or translate any portion of the Site;

  • remove, obscure or modify any copyright, trade mark, or other proprietary rights notice from the Site.

IPXYZ will not be responsible for any compensation, reimbursement, or damages arising in connection with: (i) your inability to use the Services, including without limitation as a result of any termination or suspension of the Site or these Terms, power outages, maintenance, defects, system failures, mistakes, omissions, errors, defects, viruses, delays in operation or transmission or any failure of performance, (ii) the cost of procurement of substitute goods or services, (iii) any your investments, expenditures, or commitments in connection with these Terms or your use of or access to the Services, (iv) your reliance on any information obtained from IPXYZ, (v) Force Majeure Event, communications failure, theft or other interruptions or (vi) any unauthorized access, alteration, deletion, destruction, damage, loss or failure to store any data, including records, private key or other credentials, associated with Services.

You will defend, indemnify, and hold IPXYZ harmless and all respective employees, consultants, officers, directors and representatives from and against any claims, demand, action, damages, loss, liabilities, costs and expenses (including reasonable attorney fees) arising out of or relating to (i) any third-party claim concerning these Terms, (ii) your use of, or conduct in connection with Services, (iii) any feedback you provide, (iv) your violation of these Terms, (v) or your violation of any rights of any other person or entity.

Changes are periodically added to the information herein. IPXYZ may make improvements or changes on the Site at any time. No information provided to you by IPXYZ shall be considered as advice.

Governing Law

This Terms of Service shall be deemed to have been entered into, and shall be interpreted in accordance with the laws of Germany, and any legal action concerning this Agreement shall be heard in courts located in Berlin, Germany.
